I understand and agree that there are risks associated with participation in the Guided Tours (such risks may include, among other things physical and bodily injury, disability, mental injury, death and property damage) and I expressly agree to accept and assume these risks.

I agree to release and forever discharge Bowcar Inv. Ltd. Bowcar Inv. Ltd t/a Bowcar Scooter Rentals and Guided Tours, their officers, directors, employees, volunteers, subsidiaries, agents, successors, assigns, affiliated companies and related companies, insured and their insurers (the”released parties”), of and from all liabilities, claims, actions, damages, costs or expenses, of any nature arising out of or in any way connected with my/our participation in the tours or activities, and further agree to indemnify and hold the released parties harmless against any and all such liabilities, claims, actions, damages, costs or expenses, including but not limited to, all attorney’s fees and disbursements.

I further understand that this release and indemnity agreement includes any claims based on the Negligent action or inaction of omission of the released parties and covers bodily injury, death and property damage, suffered by me or any other person inclusive of any property belonging to a Third Party, before, during or after such participation.

I further authorize medical treatment at a Licensed Medical Facility for myself at my cost, if the need arises.

I agree that any claims or demands I may have against the released parties resulting from any cause or events connected with or resulting from my participation in the guided tours occurring in The Bahamas shall be governed by and constructed in accordance with the laws of the Commonwealth of The Bahamas, and further, irrevocably agree to that the Supreme Court of The Bahamas as the exclusive venue for any such proceedings whatsoever.

I represent and warrant that I have authority to sign on behalf of myself. My name acknowledges that I have read and understood the forgoing and knowingly and voluntarily agree to all the terms of this release.
